Public procurement for sole proprietors: rules and first steps

Author — Azat Masaurov. Checked against the law on 19.10.2026.

In short

Yes, a sole proprietor (IP) can bid in Kazakhstan's public procurement like an LLP. VAT registration is not required; the simplified regime is allowed. You need an electronic digital signature (EDS), portal registration, bid security money and to meet qualification requirements, chiefly tax debt of at most 6 monthly calculation indices (MCI). Start with requests for quotations and supplying goods.

Can a sole proprietor be a supplier

Yes. Law No. 106-VIII on Public Procurement has been in force since 1 January 2025. It names, among potential suppliers, an individual engaged in business activity (Art. 3 para. 3). The law sets no separate restrictions for sole proprietors.

There are general bans that apply to everyone. For example, you cannot take part if you are on the Register of Unscrupulous Participants in Public Procurement or the Unified Register of Debtors, or if a close relative is responsible for choosing the supplier at the customer (Art. 7).

Simplified tax regime and VAT

The qualification requirements (Art. 11 of the Law) do not require VAT registration. When registering on the portal, you tick this attribute only if it applies to you.

A new Tax Code has been in force since 2026. According to the State Revenue Committee (SRC), switching to a special tax regime means deregistration for VAT. So a sole proprietor on the simplified declaration regime takes part in procurement without VAT, and the bid price should be calculated accordingly. Under the general tax regime, VAT registration becomes mandatory at 10,000 MCI of turnover per year.

Which procurement suits small businesses

Qualification requirements

A potential supplier must:

Tax debt is checked by the portal itself using data from the state revenue authorities (para. 69 of the Rules). It is better to pay off even a small arrear before submitting a bid.

Experience counts only under contracts recorded in state information systems (Art. 11 para. 1 subpara. 5). Work done "by agreement" with no trace in the systems will not count as experience.

Financial stability of a small business in procurement of works is assessed by three conditions. Income for three years is at least half of the procurement amount. Taxes paid are at least 3 % of income. Payroll for three years is at least 1/15 of the procurement amount (para. 63 of the Rules).

Licences. If an activity requires a permit or notification, the customer must require it (Art. 11 para. 4). Usually this applies to construction, design, medicine and security services. The data is taken from state systems. If it is not there, you attach a notarised or electronic copy.

Electronic signature and portal registration

A sole proprietor gets an EDS from the National Certification Authority of Kazakhstan (NCA, pki.gov.kz) on their individual identification number (IIN). To work with the key you need the NCALayer software.

Since 31 August 2026, registration and login to the supplier account go through the Unified Procurement Platform zakup.gov.kz. Everyone creates an account there, even those who previously registered on goszakup.gov.kz. After logging in with your EDS, fill in the supplier profile, including your bank account.

Bid security

Under the Law, bid security is 1 to 3 % of the procurement amount (Art. 10 para. 9). Under the Rules, it is 1 % in open tenders and auctions and 3 % in RFQs. It is paid in money to an electronic wallet or provided as a bank guarantee. More details: tparser.kz/en/guides/bid-security/
